What can be appealed?

  • Authorization or claim denied as a non-covered benefit
  • Authorization or claim denied as not medically necessary
  • Point of Service (POS) charges can only be appealed when due to an emergency

 

A proper appealing party is:

  • The patient, any age
  • The parent or guardian of a patient under age 18 (except sensitive diagnosis claims)
  • Non-network participating provider of services (cannot submit an expedited appeal)
  • A provider that has been denied approval as an authorized TRICARE provider or who has been terminated, excluded, suspended or otherwise sanctioned
  • The legal representative of the estate of a deceased beneficiary
  • An attorney acting on behalf if an otherwise proper appealing party listed above
  • The patient may appoint a representative.

Note: A completed Appointment of Representative (AOR) form must be submitted with the appeal request.

Appointed representatives MAY include:

  • Spouse, parent or legal guardian
  • Network providers; but, network providers cannot appeal without an AOR specific to the appeal being requested
  • The legal representative of the estate of a deceased beneficiary
  • An attorney acting on behalf of an otherwise proper appealing party listed above

 

What is non-appealable, but can be reconsidered or disputed?

  • Allowed amount disputes 
  • Charges denied for insufficient information or requested information not received 
  • Coding issues 
  • Cost-share and deductible issues 
  • Eligibility denials 
  • Other Health Insurance (OHI) issues 
  • Penalties for no authorization
  • Third Party Liability (TPL) issues 
  • Timely filing denials 
  • Wrong procedure code
  • Charges denied as duplicate, included in allowed amount, incidental or mutually exclusive
  • POS disputes (except when due to an emergency)
  • Authorization or referral redirected to a network provider or military hospital or clinic
  • Active Duty Service Member (ADSM) appeals 
  • Denials for CPT code 97151 (beneficiaries may discuss other options with their Autism Services Navigator (ASN)
